3. User Accounts

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and keep your account information updated.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

3.3 Account Types

• Consumer Accounts: For individuals purchasing and redeeming gift cards
• Business Accounts: For businesses selling gift cards through our platform
• Admin Accounts: For platform administrators and regional managers

4. Gift Card Terms

4.1 Purchase and Delivery

Gift cards purchased through our platform are delivered digitally to your account. All purchases are final and non-refundable except as required by law or stated in these Terms.

4.2 Redemption

Gift cards may be redeemed at the issuing business location using the QR code provided. Redemption is subject to business operating hours and any restrictions specified at the time of purchase.

4.3 Expiration

Gift cards do not expire, in accordance with applicable law. However, businesses may change, limit, or discontinue their participation in the platform.

4.4 Lost or Stolen Gift Cards

Digital gift cards are tied to your account. If you believe your account has been compromised, contact us immediately. We are not responsible for unauthorized redemptions resulting from compromised account credentials.

5. Business Partner Terms

5.1 Business Obligations

Businesses participating on our platform agree to:

• Honor all valid gift cards at full face value
• Maintain accurate business information
• Comply with all applicable laws and regulations
• Process gift card redemptions promptly and accurately
• Notify PerksPlusVIP of any changes to business status or operations

5.2 Business Termination Scenarios

A business's participation may end under the following circumstances:

6. Payments and Fees

6.1 Consumer Purchases

All prices are displayed in US dollars unless otherwise indicated. Payment must be made at the time of purchase using accepted payment methods. We reserve the right to refuse or cancel orders for any reason.

6.2 Business Fees

Businesses may be subject to platform fees, transaction fees, and other charges as outlined in their business agreement. Fee schedules are provided upon business registration approval.

7. Prohibited Activities

You agree not to:

• Interfere with or disrupt the Service or servers
• Create multiple accounts for fraudulent purposes
• Resell gift cards for profit without authorization

• Use automated systems to access the Service without permission

8. Intellectual Property

The Service and its contents, including but not limited to text, graphics, logos, images, and software, are owned by PerksPlusVIP or its licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written consent.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. WE ARE NOT RESPONSIBLE FOR THE QUALITY OF GOODS OR SERVICES PROVIDED BY PARTICIPATING BUSINESSES.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PERKSPLUSVIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless PerksPlusVIP and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, and expenses (including attorneys' fees) arising from your use of the Service or violation of these Terms.

14.2 Account Deletion by Users

Member Accounts: Members (consumers) may request deletion of their account at any time through the platform settings. Account deletion is processed within a reasonable timeframe.

Business Accounts: Business accounts cannot be self-deleted through the platform. Businesses wishing to close their accounts must contact our support team to initiate the account closure process. This ensures proper handling of outstanding gift cards and financial obligations.

14.3 Gift Card Forfeiture Upon Account Deletion

By deleting your account, you acknowledge and agree that:

• All gift cards associated with your account will be deactivated
• Any unredeemed balances will be forfeited without refund
• Forfeited gift card value returns to PerksPlusVIP's available inventory
• This action is irreversible—you cannot recover forfeited balances

We strongly recommend redeeming all gift card balances before requesting account deletion.

14.4 Re-Registration Restriction

This restriction is in place to:

• Prevent abuse of new user promotions and referral programs
• Maintain platform integrity and prevent fraudulent activity
• Ensure fair treatment of all users

If you believe you have a legitimate need to create a new account after deletion, you may contact our support team to discuss your situation.

14.5 Data Retention After Deletion

As described in our Privacy Policy, certain data will be retained after account deletion for legal compliance, fraud prevention, and legitimate business purposes. This includes transaction history, usage analytics (in anonymized form), and the email address used for registration.
